What You Need to Know About Electric Scooter Accidents in Michigan
Electric scooters have become increasingly popular in Detroit and other cities in Michigan. These simple devices offer a convenient way for people to travel at moderate speeds without having to own a car or pedal a bike. Unfortunately, as with any vehicle, accidents can still happen with electric scooters.
Here is what you should know if you want to ride a scooter in Michigan.
Scooter Laws in Michigan
First, you do not need a license to ride a scooter in Michigan. Scooters are treated as mopeds, so riders must follow moped regulations, except that they are not required to be registered.
Perhaps the most important rule when it comes to scooters is that there are locations where they can’t be ridden. Scooters may not be operated on any road with a speed limit of 45 mph or greater. Furthermore, riders under the age of 12 years old cannot ride scooters on any public streets.
On streets where you can legally ride a scooter, you must ride along the right-hand side of the road whenever possible. Additionally, if you are 18 years old or younger, you must wear a helmet while riding a scooter.
Scooter Accidents and Insurance Coverage
If you are involved in a motor scooter accident in Michigan, the most important question will probably be who pays compensation for any injuries. The answer to that question depends on several factors.
When a Car Driver Pays
Even though Michigan has a no-fault insurance system, that system doesn’t apply when the other vehicle is a motor scooter. When a car and a motor scooter strike, the car driver — or more likely, their insurance company — will cover compensation for the accident if they were negligent.
Common examples of driver negligence are driving while texting or ignoring traffic laws.
When a Scooter Rider Pays
Negligence works both ways, though. If the scooter driver was ignoring traffic regulations or engaging in otherwise negligent behaviors, they may be liable for their injuries, even if they get into an accident with a car. The scooter rider would also be responsible for paying for any injuries to the other party. This is most likely to be relevant when a scooter rider strikes a pedestrian.
When the Scooter Rental Company Pays
Many scooters on Detroit roads aren’t owned by the person riding them. Instead, they are rented. In some cases, the scooter rental company may be responsible for compensating both parties.
This will typically be the case when the rental company fails to properly maintain the scooter and that lack of maintenance results in the accident. For example, if the brakes fail and cause a scooter driver to run a red light, the rental company would likely be responsible.
