Fines and Penalties Increase in Michigan Road Construction Work Zones

As the 4th of July approaches, many of us look forward to heading up north, celebrating with family and friends, enjoying barbecues, and maybe even watching fireworks. However, the holiday also brings an increase in traffic, and it’s crucial to stay vigilant to avoid car accidents, especially when driving through road work zones where stricter traffic laws have been mandated.
According to MDOT (Michigan Department of Transportation) Michigan has had strict traffic laws on the books for years that ensure the safety of both workers and motorists in these areas. Unfortunately, many drivers still speed or become distracted, endangering the lives of our vulnerable road workers. It’s essential to understand the serious consequences of such actions.
The Consequences of Violating Traffic Laws in Work Zones
Speeding in work zones doesn’t just put lives at risk—it can also result in severe penalties. In Michigan, fines for speeding in work zones are doubled, and the number of points assessed to your driving record increases significantly:
- 3 points for speeding 10 mph or less over the posted limit.
- 4 points for speeding more than 10 mph but not more than 15 mph over the limit.
- 5 points for speeding more than 15 mph over the limit.
Accumulating 12 or more points within two years can lead to a driver assessment reexamination by the Michigan Secretary of State. Your license may be restricted, suspended, or revoked depending on the outcome.
Additionally, points on your driving record can lead to increased insurance rates. Michigan traffic law allows insurers to add a surcharge to the policies of drivers with poor driving records, reflecting the higher risk they pose on the road.

Jail & Fines: For Injuring a Road Worker
Michigan takes the safety of road workers very seriously, as evidenced by the enactment of Public Act 103, this traffic law known as Andy’s Law, took effect on October 1, 2001. This law imposes severe penalties for injuring or killing highway construction or maintenance workers:
- Up to one year in prison for injuring a worker.
- Up to 15 years in prison for killing a worker.
- Fines up to $7,500.
Andy’s Law is named after Andrew Lefko, a 19-year-old who was left paralyzed after being hit while working on I-275 in Metro Detroit.
In 2003, Public Act 315 strengthened Andy’s Law by marking work zones with clear signage and extending penalties to driving offenses like careless or reckless driving, not just criminal offenses.
Traffic Law: Andy’s Law Update
In 2008, Andy’s Law was broadened to impose the same penalties on motorists who injure or kill anyone in a work zone, not just workers. This update, encapsulated in Public Acts 296 and 297, includes:
- Fines up to $7,500.
- Up to 15 years in prison for causing injury or death in a work zone.
This extension reflects Michigan’s ongoing commitment to protecting everyone on the road.
