Congratulations to Jason Blankenship on Michigan Supreme Court Victory
At Giroux Pappas Trial Attorneys, we believe great results come from great advocacy—especially when that advocacy reaches the highest court in the state.
We are proud to congratulate Jason Blankenship, of counsel attorney, on his recent success before the Michigan Supreme Court in Swoope v Citizens Insurance Company of the Midwest.
In a unanimous decision, the Michigan Supreme Court reversed the Court of Appeals and clarified an important protection for injured drivers under Insurance Code MCL 500.3113(a).
A Win at the Highest Level
Taking a case to the Michigan Supreme Court is no small task. It requires:
- A deep understanding of the law
- Precision in briefing
- Confidence in argument
- And the willingness to stand behind your position at the highest level
Jason Blankenship delivered on all fronts. His work helped secure a ruling that reinforces a clear and important principle: Drivers are only excluded from no-fault benefits if the vehicle was taken unlawfully—and the driver knew or should have known it.
The Court made clear that:
- Licensing status does not matter
- Driving behavior does not matter
Those factors cannot be used to deny benefits.
A Legal Victory For Michiganders
This decision is more than a legal victory—it’s a meaningful win for injured people across Michigan. By rejecting efforts to expand the no-fault exclusion, the Court preserved access to critical benefits for those who need them most. And it did so by returning the focus to what the law actually says.
Our Perspective
We are proud to work alongside attorneys like Jason Blankenship—lawyers who not only understand the law, but are willing to fight for it at every level. Because achieving justice doesn’t always happen in one courtroom. Sometimes, it requires taking the argument further. Standing firm. And being ready when the stakes are highest. Jason’s success in this auto accident case reflects exactly that.
Congratulations, Jason Blankenship, on an outstanding result before the Michigan Supreme Court.
