How Much Can You Be Paid for Wrongful Imprisonment?

Michigan is one of the 33 states with a statute that provides monetary compensation for persons who have been exonerated

Michigan provides for statutory compensation for persons who have served time in a state correctional facility for 1 or more crimes that he or she did not commit. The statute is known as the Wrongful Imprisonment Compensation Act (“WICA”). If a court determines that the person has proved all of the elements under WICA by clear and convincing evidence, the Court may award compensation, including $50,000 for each year of imprisonment and reasonable attorney fees.

This award of damages under WICA is not absolute and there are several statutory factors that must be met. You may also be entitled to compensation for a violation of your constitutional rights.
