What to Do in a Chain Reaction Accident
Although there is no legal definition, a chain reaction accident typically refers to collisions involving three or more vehicles. These accidents normally occur in heavy traffic when one driver collides with another (usually rear-ending), triggering a domino effect.
If you’re caught in a chain reaction accident, your priority should be to ensure your safety.
What to Do: Immediate Steps
- Ensure that everyone in the car has their seatbelt fastened.
- Put your hazard lights on, and stay in the car, unless there is a risk of fire or further collisions.
- If you are uninjured, check the other passengers in your car to make sure they’re OK.
- If passengers are injured, perform first aid when necessary, but only if it’s safe to do so.
- As soon as it’s safe to do so, call law enforcement.
- Do not exit the car until the police and EMTs have secured the scene.
Next: Reporting & Documentation
Once police and EMTs have secured the scene and you’ve collected your thoughts:
- Write down relevant information, such as the make, model, color, year, and license plate of the cars involved, and the names and contact information of the drivers.
- Take photos of the scene.
- Get witness statements.
- File a police report.
- Seek medical attention. Some injury symptoms may be delayed, so we always advise getting medical care, even if you feel fine on the day of the accident.
Filing a Claim After a Chain Accident
Regardless of fault, Michigan’s no-fault law ensures that drivers involved in car accidents get medical coverage, regardless of who was at fault. Unfortunately, some insurance companies may find a reason to deny your claim, especially in complex chain accidents that involve multiple parties.
In no-fault states like Michigan, your own insurance company is supposed to pay for your medical bills and any lost wages, regardless of who is at fault.
Common Reasons for Claim Denial
- Conflicts in stories (witness reports and dashcam footage can be helpful).
- Uninsured/underinsured drivers
- PIP coverage limits have been exhausted (common in chain accidents with multiple injuries).
- The insurance company’s medical examiner declares treatments medically unnecessary.
- Failure to provide adequate documentation.
- Delaying seeking medical treatment (Michigan doesn’t have a hard deadline to seek treatment, but if delayed, insurance companies may not find it necessary to pay if the injuries aren’t serious enough).
- Treatment provided by a non-qualifying provider
- You filed the benefits claim too late (In Michigan, you have one year to recover medical expenses).
- Gaps in treatment
When to Seek Help From an Attorney
Claim denials are common. We recommend seeking legal help as soon as possible, before filing a no-fault claim. Michigan’s no-fault law is incredibly complex; specific deadlines and procedural requirements can impact your claim. Additionally, if the chain reaction accident resulted in serious impairment of body function, you still have the right to pursue a liability claim and sue the at-fault driver, even if you receive medical expense coverage from your insurance company.
Avoiding a Chain Reaction Accident
You can’t control other drivers, but you can control your own driving.
The best advice we can give is:
- Don’t drive distracted, even if you woke up late and are rushing to get to work. Remember that driving is a dangerous activity. People die from auto accidents.
- Don’t tailgate other drivers. There are passing lanes. Use them when needed.
Certain road conditions can also increase the likelihood of a chain reaction, including snow, fog, heavy rain, and hail. Try to avoid driving in these conditions, and if you can’t avoid it, drive defensively. Give yourself more space than you think you need, and drive slower.
