A client’s husband was taken to the hospital because of his chest pain. Our client informed hospital staff that he required close supervision due to his dementia and blindness. A wrongful death claim is a civil action brought when a person dies as a result of another person’s negligence, wrongful act, recklessness, or an intentional act. Under Michigan’s Wrongful Death Act, the claim is brought by the estate on behalf of the surviving family members.
In Michigan, a personal representative of the deceased person’s estate can file a claim on behalf of the surviving family such as spouses, children, parents and others that might be named. Compensation is distributed to eligible family members (heirs).

The statute of limitations is identified by the subject matter of the case (auto, medical, premises, etc.). However, the time starts to run only after an Estate is first opened, not to exceed 5 years.
