In just 24 hours, three separate trench collapses at construction sites across Southeast Michigan left one worker dead and two others injured. According to news sites, the incidents happened in Oxford Township, Orion Township, and Handy Township near Fowlerville in Livingston County. These construction site accidents, are a sobering reminder that construction work remains one of the most dangerous occupations in America. Many of these tragedies and the construction site injuries that occur may be preventable if companies would follow safety protocols.

According to reports by police and The Detroit Free Press, the first incident occurred in Oxford Township, where a 35-year-old worker became buried during a trench collapse and was rescued by first responders. Less than a day later, a 25-year-old worker was trapped during a trench collapse in Orion Township while working on a sewer installation in a new residential subdivision. Fortunately, coworkers and emergency responders were able to free both men and get them to the hospital.

The third incident ended in tragedy. According to WXYZ a 23-year-old man has died following a trench collapse at a construction site near Fowlerville. A crew was installing underground tanks for a new gas station when the young man was trapped in the trench. Life saving efforts were made but he died on the scene. The Michigan Occupational Safety and Health Administration (MIOSHA) is investigating all three incidents.

Trench Collapses Are Often Preventable

Construction sites present numerous hazards, but trench collapses can cause catastrophic injuries that can be life changing and sometimes deadly. Soil can weigh thousands of pounds per cubic yard, and when trench walls give way, workers can become trapped within seconds.

OSHA Safety Regulations for Construction

The Occupational Safety and Health Administration (OSHA) provides safety and health regulations for construction industry among others. There are very specific requirements for excavations and the protective systems (Standard Number 1926.652) that need to be put in place to protect construction employees.

Federal and state safety regulations exist for a reason. Depending on the depth of the excavation and the soil conditions, employers are generally required to implement protective systems such as:

  • Proper trench boxes or shielding
  • Sloping or benching trench walls
  • Protective shoring systems
  • Regular inspections by a competent person
  • Safe access and exit points
  • Continuous monitoring as site conditions change

When these safety measures are ignored—or when contractors rush a project to save time or money—the result can be catastrophic construction accident injuries.

When Construction Site Injuries Are Caused by Negligence

Not every construction accident is simply an unfortunate event. In many construction injury cases, investigators uncover evidence that safety protocols were ignored, hazards were known but left unaddressed, or proper equipment was never provided. Potentially responsible parties may include:

  • General contractors,
  • Subcontractors,
  • Property owners,
  • Excavation companies,
  • Equipment manufacturers,
  • Engineering or site planning firms

If a third party’s negligence contributed to the accident, an injured worker—or the family of someone who lost their life—may have the right to pursue a separate personal injury or wrongful death claim. While workers’ compensation often provides benefits for injured employees, it may not be the only avenue for recovery. Determining who is liaible often requires a thorough investigation into who controlled the worksite, who was responsible for safety, whether OSHA or MIOSHA regulations were violated, and whether the accident could have been prevented through reasonable care and if safety measures were followed.

Every Construction Worker Deserves a Safe Workplace

Construction workers help build our homes, schools, hospitals, roads and infrastructure. They should never have to sacrifice their safety because corners were cut or safety standards were ignored. These three trench collapses across Southeast Michigan serve as an important reminder that workplace safety cannot be treated as optional. Every employer has a legal responsibility to provide a safe work environment and follow established safety regulations designed to protect workers’ lives.
